1. Who We Are and What This Policy Covers
Hotel Brokers of America, Inc. (“HBA,” “we,” “us” or “our”), 8330 Lyndon B Johnson Fwy, Suite #375, Dallas, Texas 75243, operates hotelbrokersinc.com (the “Site”). This Privacy Policy explains what personal information we collect through the Site, by phone, by text message and in related brokerage communications, how we use and share it, and the choices you have.
This policy applies to visitors, newsletter subscribers, prospective buyers and sellers, investors, and cooperating brokers. It should be read with our Terms and Conditions. It does not apply to third-party websites we link to, which have their own policies.
HBA does not sell your personal information.

We do not ask for Social Security numbers or bank account numbers through the Site’s web forms.
3. How We Use Your Information
- Respond to inquiries and provide hotel brokerage services;
- Match buyers with hotel listings and 1031 replacement properties, and send listing alerts and our monthly newsletter;
- Send text messages you have agreed to receive (see Section 5);
- Market properties for sellers who have engaged HBA;
- Introduce buyers to hotel lenders and capital sources at the buyer’s request;
- Document NDAs, registrations and introductions, and enforce our Terms and Conditions;
- Meet legal, licensing and recordkeeping obligations; and
- Operate, secure and improve the Site.
4. How We Share Your Information
We share personal information only as needed for the purposes above:
- Transaction parties: sellers, buyers and their representatives, as needed to evaluate or close a deal.
- Lenders and capital sources: only when you ask for a financing introduction.
- Cooperating and affiliated brokers: licensed brokers working on the same transaction and local Brokers of Record.
- Closing professionals: title and escrow companies, Qualified Intermediaries, attorneys and inspectors involved in your transaction.
- Service providers: website hosting, email, phone and SMS delivery, CRM, e-signature and document storage vendors that process data on our behalf under confidentiality obligations.
- Legal reasons: when required by law or to protect HBA’s rights.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the categories of sharing above exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, except service providers (such as our SMS platform) that deliver messages on our behalf.
5. Text Messaging (SMS) Privacy
If you provide your mobile number and opt in, Hotel Brokers of America may send you text messages about your inquiry, hotel listings that match your criteria, deal and document updates, appointment reminders and follow-ups.

- Reply STOP at any time to opt out. Reply HELP for help, or contact us at (661) 808-4998 or Deals@hbofamerica.com.
- Consent to receive text messages is not a condition of any purchase or service.
- We use your mobile number and opt-in information only to send the messages you agreed to receive and to honor opt-out requests. We do not sell, rent or share it with third parties or affiliates for their marketing.
- Carriers are not liable for delayed or undelivered messages.

6. Cookies and Email
The Site uses cookies and similar tools to operate, remember preferences and measure traffic. You can block or delete cookies in your browser settings, though parts of the Site may not work properly. Marketing emails include an unsubscribe link. We may still send transaction-related messages after you unsubscribe.
7. Retention and Security
We keep personal information as long as needed to provide services, meet real estate licensing and recordkeeping requirements, and enforce our agreements. We use reasonable administrative, technical and physical safeguards. No system is completely secure, so please do not send sensitive financial or identification information by unencrypted email or text.
8. Your Privacy Rights
Depending on where you live, you may have the right to access, correct or delete the personal information we hold about you, and to opt out of the sale of personal information or targeted advertising (HBA does not engage in either). To make a request, email Deals@hbofamerica.com with the subject “Privacy Request.” We will verify your identity and respond within the time the law requires. You may appeal a denied request by replying to our decision. We will not discriminate against you for exercising your rights.
9. Children
The Site is intended for adults conducting commercial real estate business. We do not knowingly collect information from anyone under 18.
10. Changes to This Policy
We may update this policy by posting a revised version with a new Effective Date.
